We have been privileged to be trusted to defend the licenses of Daycare Centers, Family Day Care Homes, Nurses, and Physicians.  This is a huge responsibility because not only are we responsible for the livelihood of the licensee but also their reputation in the community and their peer groups.  We understand if we fail to turn over every bit of evidence and allow the true facts to come to light we have failed in our most serious task.  Have we won every case?  No.  Have we lost any case because we were not diligent and out worked the other side?  Never.  We evaluate every case on its merits and its problems.  There are no one size fits all.  We use investigators, medical and technical experts, and a lot of common sense and tenacity.

 

We represented a provider who had been accused of hitting a child with a shoe.  The child had a mark that certainly looked like it matched the provider’s shoe.  Her daycare facility had been closed by the State and everyone from the LPA to the investigators said this was an open and shut case of child abuse.  However, the provider was calm and consistent in her denial of her guilt.

Based on the client’s denial of the hitting. We were able to secure the authority to have the shoe and the photos reviewed by an expert who viewed the marks under a microscope and found the marks actually did not mach.  The license was saved and the provider was put on probation for another violation but she re-opened and is in business.

 

Sexual abuse allegations are very difficult to defend.  We have found a Harvard trained pediatrician who is Board Certified in Childhood Behavior….  She has become an integral part of our team who testifies eloquently as to why a child may have made the accusation or how their words are being misconstrued.  One little girl tried to tell her mom and the forensic interviewer for the State that she had not been molested.  They did not listen and on the forensic tape of her interview she looks disgusted and picks up her toys and walks to the door.  Our expert was able to correctly interpret the child’s actions and explain she is trying to be heard but was essentially ignored.  During the Hearing the evidence pointed to how she was acting out with her grandmother what she had witnessed from her bed in her mother’s bedroom between her mother and a boy-friend.  The provider kept her business, her home, and her good reputation.

 

We have assisted many medical personnel to keep their licenses.  One young nurse had a terrible history of drug abuse and arrested multiple times.  However, she had gotten away from her bad friends, stopped all drug and alcohol abuse, remained sober seven years and gone to nursing school.  The Board of Registered Nursing was not going to approve her to take the Nursing Boards.  We were able to negotiate a settlement whereby the nurse would attend specific classes and workshops, plus make her employer aware of the issues so she would have extra scrutiny in handling drugs.  She has completed her probation, is working in a hospital, and her criminal record has been expunged.
